1.Introduction

Curtiss-Wright Corporation (CW) is a diversified, multinational provider of highly engineered, technologically advanced products and services and we need to collect and process personal data relating to individuals who wish to apply for a job within our organisation.

2.Purpose

CW is committed to meeting its data protection obligations and being transparent about how it collects and uses your personal data. This Candidate Privacy Statement describes how CW, as Data Controller, processes your personal information throughout our candidate recruitment and selection process when you apply for a position within CW. Candidate applications can be for a permanent, temporary or fixed term contracts of employment.

This Candidate Privacy Statement supplements CW data protection policy and our Privacy Notice | Curtiss-Wright Corporation has more detailed privacy information, including the kind of data we hold, what it is used for and the principles for processing personal information to which we adhere.

3.Applicable Laws

As a global organisation, CW processes candidate data to the standards required of the EU and UK General Data Protection Regulation (GDPR), but in certain circumstances, CW processing activities will fall under the remit of national legislation beyond the scope of GDPR.  Where such differences to GDPR occur, CW will analyse the relevant processes and implement appropriate measures that meet local requirements, ensuring an adequate level of protection for candidate personal information. 

4.Purposes of Processing

CW processes your personal data for the following purposes:

  • To evaluate your application and make selection and hiring decisions.
  • To communicate with you, to inform you of the CW recruitment, selection and hiring process, to discuss application progress, success or failure, interview arrangements, or any other required communications.
  • To comply with applicable legal and regulatory requirements and for CW to establish, exercise or defend a legal claim.
  • To conduct employment and corporate management obligations, such as establishing an employment record for you, in the event you are a successful candidate. If you are offered and accept employment with CW, the data collected during the CW recruitment, selection and hiring process will become part of your employment record.
  • To conduct reviews and analysis of CW recruitment, selection and hiring processes, including aggregated reporting on candidates’ activity data such as careers site traffic, candidate funnels, sources of hire, recruiting campaign success.

5.Personal Data We Collect

a. Data Collection:  The CW candidate recruitment and selection process involves multiple steps designed to help us evaluate a candidate’s skills, qualifications and suitability for a particular job vacancy and we will need to collect personal data from you, including:

  • Personal details such as your full name and if applicable, veteran status.
  • Contact information including your home and email addresses, telephone number(s).
  • Professional and educational data related to you, such as current or previous employers, your job title, or other information about any organization with which you are affiliated.
  • CV/resume information about qualifications and education, such as degrees, fields of study, institutions attended, certifications.
  • Career preferences such as short and long-term goals, willingness to relocate, homeworking, availability and other preferences.
  • Personal information derived from your participation in our recruitment process, such as, information or opinions obtained during interviews, or from email communications we exchange with you.

b. Sensitive Personal Data:  CW does not process your sensitive personal data during the candidate recruitment and selection process.

c. The Hiring Process:  Commences when a successful candidate is offered a conditional offer of employment.  Subject to your regional jurisdictional requirements, and where we are lawfully empowered to do so, and if the information is necessary to a potential working environment at CW, we will collect more detailed confidential and sensitive information about you, including information obtained by right to work and background screening checks.  How CW manages this data is described in our CW Privacy Notice (Staff), which you will receive when you receive a conditional offer of employment.

6.Sources of Personal Data

CW will collect your personal data from a variety of sources:

a. Directly from you: During the recruitment, selection and hiring process and personal information is submitted to CW via our recruitment portal, company websites, telephone conversations, email and other candidate communications with CW. 

b.  Indirectly:Via approved third parties who are lawfully entitled to share candidate information with us such as employment and recruitment agencies (for example, when an agency identifies a potential candidate).

7.Data Sharing

Those responsible for our candidate recruitment, selection and hiring processes work closely with relevant hiring managers and local Human Resource staff to facilitate candidate applications, wherever they may be. CW will only share your personal data under the following circumstances:

a.  CW Entities:  We will share appropriate personal data relevant hiring managers, interviewers and local Human Resource staff to facilitate candidate applications.  We may also share your personal data with CW personnel in other CW entities located in jurisdictions around the world for evaluating your candidate application. 

b. Third-Party Service Providers:  CW may specifically share your personal information with approved third-party service providers that perform general business operational services such as information security as well as services more specifically related to our candidate recruitment, selection and hiring processes. Such third parties may vary depending on your country of residence and will change from time to time.

c.  Authorities:  CW may be obliged to share your personal data with law enforcement, regulatory or government agencies, the judiciary or any other similar agency where we believe the disclosure is necessary under applicable law or in the good-faith belief that such action is necessary to exercise, establish or defend our legal rights.

8.Automated Decision-Making and Profiling

CW do not conduct any automated individual decision-making (decisions made solely by automated means without any human involvement) or profiling (automated processing of personal data to evaluate certain things about you), during our candidate recruitment, selection and hiring process.

9.Lawfulness of Processing

CW will only ‎collect, use and disclose candidate personal information for purposes that a reasonable person ‎would consider appropriate in the circumstances however, certain jurisdictions require CW to have a legal or lawful basis for processing your personal information.  Our lawful basis for collecting and using your personal data as described in this Candidate Privacy Statement depends on where you reside, the personal data we collect from you and why we collect it.  The lawful basis under which CW will process your personal data are:  

a.  Contract: Processing is necessary for the performance of a contract and take steps, at your request, with the intention of entering a contract of employment or similar engagement with you.

b.  Legitimate Interests: Processing is necessary for the legitimate interests pursued by CW, who wish to recruit and appoint new employees and the candidate, who wishes to be appointed.

c.  Legal Obligations:  Processing is necessary for compliance with a legal obligation to which CW must comply, such as employment and other laws.

d. Consent:  Where you have given CW consent to the processing of your personal data for one or more specific purposes.

10. International Data Transfers

CW is a global organisation and candidate personal data will be transferred to and processed in countries other than the country in which you are resident. It is possible these countries have data protection laws that are different from the laws of your country and, in some cases, may not be as protective,

CW will always take reasonable steps to protect your privacy and to provide a level of protection of your personal data that is at least comparable to that of your country of residence.  CW only engages third-party data processors who have been assessed as a competent data processing organisation that can demonstrate the implementation of appropriate technical and organisational measures, including standard contractual clauses, that safeguard our personal data transfers in accordance with applicable privacy law.

11. Personal Data Security

CW adopts reasonable and appropriate technical and organisational measures that help to protect your personal data from accidental loss and unauthorized access.  CW employees who process your personal data are appropriately trained to do so and are also subject to confidentiality obligations.

12. Data Retention

CW will retain your personal data for as long as necessary in relation to the purposes described in this Candidate Privacy Statement.  We do this in accordance with our Corporate Record Retention Policy and dedicated records retention schedules, or as required by applicable law, or if necessary to establish, exercise or defend a legal claim.

  • If your application for employment with CW is successful, personal data gathered during the candidate recruitment and selection process will be transferred to your HR employee file.
  • If your application for employment with CW is unsuccessful, we will retain your candidate application information in accordance with applicable privacy law, after which it will be destroyed.

13. Individual Rights

National and international data protection law governs our processing of your personal data, and you may have certain rights in relation to your personal data. Subject to your regional privacy legislation, you may have the right to:

a.  Be informed about the collection and use of your personal data. You have received this information within this Candidate Privacy Statement.

b. Access your personal information. Allows you to obtain a copy of your personal information as well as other supplementary information. 

c.  Request deletion or destruction of your personal information in certain circumstances. For example, if it is no longer necessary for us to process your personal information for the purposes for which it was originally collected.

d. Correct inaccurate personal data or update it if required. Please keep us informed if your personal information changes during your relationship with us.

e.  Object to the processing of your personal data or ask us to restrict or suppress processing of your personal information that is likely to cause, or is causing you, damage or distress.

f.  Request portability of your personal information. This allows you to obtain and reuse your personal data for your own purposes across different I.T. services, perhaps with different organisations. 

g. Stop your data being used for direct marketing purposes. This is an absolute right.

h. Not have a decision made about you that is based solely on automated decision-making or profiling, CW does not, in any part of our candidate recruitment, selection and hiring processes, make solely automated decisions about candidates.

You also have the right to complain to a Supervisory Authority responsible for overseeing compliance with data protection law in your jurisdiction, if you believe our processing of your personal information does not comply with data protection law.  CW would however appreciate the chance to address your concerns, so please feel free to contact us regarding any complaint you may have. CW will not discriminate against individuals for exercising their data privacy rights.

You should be aware that not all the data subjects’ rights are absolute and will apply in certain circumstances only. For example, CW is obliged to maintain certain records for legal reasons and in this scenario, you would be unable to have data deleted or destroyed.

CW will facilitate your exercise of the rights that apply to you in accordance with applicable law. However, even if your personal data is not afforded protection under, or otherwise subject to, a data protection law, we may seek to accommodate any request or inquiry you may have regarding our data processing activities.

14. California Residents

The information contained in this section is required by the California Consumer Privacy Act (CCPA) and supplements, and is supplemented by this CW Candidate Privacy Statement and the CW corporate Privacy Notice: Privacy Notice | Curtiss-Wright Corporation.

a.  Principles of Processing: CW will process your personal data in accordance with the principles for processing personal information defined in our corporate Privacy Notice: Privacy Notice | Curtiss-Wright Corporation.

b. Your Rights: You have certain rights in relation to the processing of your personal information. You have the right to:

  • Know the categories of personal information we collect (Section Personal Data We Collect).
  • Know the specific pieces of personal information we collect (Section Personal Data We Collect.
  • Know the categories of sources from which we collected personal information (Section Sources of Personal Data).
  • Know the purposes for which we use your personal information (Section Purposes of Processing).
  • Know the categories of third parties with whom we share your personal information (Section Data Sharing).
  • Know the categories of information that we sell or disclose to third parties (Section Data Sharing).
  • Request that we delete your personal information.

You should be aware that not all rights are absolute and may apply in certain circumstances only. In accordance with applicable law and processes that may require identity verification, CW will provide you the information you request for the 12-month period preceding your request, free of charge and within 45-days.

c.  Disclosure of Subject Access Requests: The CCPA requires us to disclose the number of requests received, complied with, in whole or in part, or denied. Subject Access Requests to access personal information as described above, are processed within 45 days.

  • During the previous 12 months from the date of this Candidate Privacy Statement, CW has received no subject access requests.

d. Non-Discrimination:  You may make these requests yourself or use an authorised agent. If you have questions about your rights or wish to exercise your rights, you, or your agent, can contact us via [email protected]

  • CW will not discriminate against individuals for exercising their data privacy rights.

e.  Sale: CW do not sell personal data, so we do not offer an opt-out to the sale of your personal data.

f. Security: CW takes the security of your personal data seriously. Please see the section Personal Data Security.

g. Complaints: You also have the right to complain to the California Office of the Attorney General, who are responsible for overseeing compliance with CCPA, about our collection and use of your personal information, if you believe our processing of your personal information does not comply with the CCPA. 

  • If you believe CW has violated the CCPA, you may file a Consumer Complaint with the Office of the Attorney General. If you choose to file a complaint, you will need to explain exactly how CW violated the CCPA and describe when and how the violation occurred.

15. Changes to this Candidate Privacy Statement

This Candidate Privacy Statement is available to candidates via our CW websites.  It is reviewed regularly and can be updated in response to changing legal, technical or business requirements and it was last updated on the data shown in the document header.
